  1. PAYMENTS BY HIRER
  1. The Hirer shall pay the Operator for the hire of the Vehicle the sum or sums agreed upon as per your Booking confirmation. Payments can be made in Rwandan Francs: ………………………………….. USD……………. Or Euros ………………..as per the operator’s standard exchange rate. Dollars Notes accepted by the Operator start from 2009 print notes and above.
  2. Payments for the rental are always made in cash upon arrival or by bank transfer to our USD account in Kigali-Rwanda, or Visa credit card with the extra bank Surcharge (4%).
  3. In addition to the payment specified in section (2) (a) above, the Hirer acknowledges that she/he will be liable at the end of the hire period to pay the Operator any applicable additional charges that may raise in the time of the rental, these may include charges for extra days used, late return contrary to the time agreed with operator’s agent, damage to or repair of the Vehicle (subject to the other terms of this Agreement) like traffic fines, fines and toll charges and border crossing exit confirmation fines.
  4. The fuel/oil expense will be met by the hirer of the vehicle during the period of hire.

 

  1. USE OF THE VEHICLE

The Hirer must not:

  1. use or allow the Vehicle to be used for the transport of passengers for hire or reward unless the Vehicle is hired with the Operator’s knowledge for use in a passenger service license and should not exceed the carrying capacity of the car as per the insurance License or the number specified on the contract.
  2. Sublet or hire the Vehicle to any other person or allow the Vehicle to be used outside his/her authority thus those not party to the contract;
  3. Operate the Vehicle or allow it to be operated in circumstances that constitute an offence against any law in Rwanda & other east African Community countries (Uganda & Tanzania).
  4. Operate the Vehicle or allow it to be operated in any race, speed test, rally or contest;
  5. Operate the Vehicle or allow it to be operated in breach of the agreement.
  6. Drive the Vehicle on any roads contrary to sections 7, 8 and 9 of the Agreement.
  7. No replacement or substitute of any parts or accessories of the vehicle without the knowledge and approval of the operator.
  8. To propel or tow any vehicle on trial without the consent of the operator.

 

  1. HIRER’S OBLIGATIONS

The Hirer must ensure that:

  1. All reasonable care should be taken when driving and parking the vehicle whereby if the damage occurs then it’s the responsibility of the hirer to pay not the operator.
  2. The water in the vehicle’s radiator and battery is maintained at the proper level;
  3. The oil in the vehicle is maintained at the proper level;
  4. the tires are maintained at their proper pressure, But for the flat tires a client has to cater for this as this is avoided, but when it’s beyond repair a new one will be fixed but at a shared cost
  5. The vehicle is locked and secured at all times when it is not in use;
  6. No part of the engine, transmission, braking or suspension systems are interfered with; should a warning light be illuminated or the Hirer believes the vehicle requires mechanical attention; they stop driving and advise the Operator immediately.
  7. Payment of Traffic fine charged during the rent period
  8. Payment of parking fees charged during the rent period
  9. Return the car with all related documents

 

  1. OPERATOR’S OBLIGATION

The Operator will supply the Vehicle in a safe and road-worthy condition, displaying valid Third party insurance.

  1. MECHANICAL REPAIRS AND ACCIDENTS
  1. If the vehicle is involved in an accident, is damaged, breaks down or requires repair regardless of cause, the Hirer shall notify the Operator of the full circumstances immediately.
  2. The Hirer shall not arrange or undertake any repairs or leave the scene of the accident before police inspection or without the Operator’s authority.
  3. In case of an accident, the client is supposed to make a statement to the nearby police station. If the statement is found to have some fraudulent intention, a person will be liable for making a false statement when they knowingly and willfully falsify, conceal, or cover up by any trick, or scheme, to a fine of an extra 400 USD.
  4. If the vehicle requires repair attention, the operator shall arrange repairs to the vehicle within a reasonable time frame depending on the location of the breakdown, if the breakdown was a result of a breach of Section 4, the hirer will be required to pay the repair costs.
  5. In case of a mechanical breakdown, we provide a replacement car within 24 Hours in Rwanda and 72 Hours across the border, the operator is responsible for the replacement car fuel as the hirer is responsible for the fuel of the broken down car to return to Kigali Rwanda ( Operator address)

 

  1. INSURANCE

The Operator’s rental fleet is insured under a policy of motor vehicle insurance (“Policy”) from a person or company licensed to carry on insurance business in Rwanda as per the Rwanda Insurance Act.

The operator’s Insurance Policy Carters for Only the Vehicles, Head Collusion and theft for the Vehicle and doesn’t provide Personal Life Insurance for the occupant so you’re required to come with life insurance from your home country and may have extra Insurance. This Insurance does not cover any damage caused by negligence such as driving under the influence of alcoholism, wheels/trims, cigarette burn (Our vehicles are all non-smoking), punctures, damage to radio covers, badges, passing through water and the engine knocking etc…

  1. Immediately notify the police if another party s guilt is to be ascertained or if any person is injured
  2. Therefore clients are entitled to make Police Statement when he or she gets accident because it is the basis for the police report and the operator will base on this to process the claim from the insurance for the damages to the car.
  3. The Excess insurance charged by the operator will vary depending on the car type: Toyota Corolla & Rav4 (Series: 2000-2010) USD 350 and Land cruiser Prado TZ, GX, VX 700 USD, Luxury jeeps: Rav4 (2014-2018) Series, LX 7.0, Toyota Land cruisers V8, GX, TX(L) Excess insurance is USD 1000.
  4. The hirer will comply with the terms and conditions of the insurance policy and pay the owner any excess in the event of the claim
  5. The hirer will solely be responsible for towing truck expenses from the location of the accident to Go Safaris Africa Ltd premises
  6. Rooftop Tents and camping gears are not part of the insurance in case of any damage, the client is shall pay the costs of replacing the tent at the original cost as per the Quotation from the Manufacturing Tent. co at USD 1000.

IMPORTANT: The Operator is not providing insurance services to the Hirer. The Operator manages the insurance provided under the Policy (Avenue Insurance Brokers on behalf of the insurance company). The Operator reserves the right to determine whether or not to claim under the Policy. In the event of damage to the Vehicle, the Hirer agrees to immediately contact, and solely deal with the Operator.

  1. THE HIRER WILL NOT BE COVERED UNDER THE POLICY (and therefore is Personally liable for all damage) if –

Note: Areas where the client is 100% responsible for damages to the car:

  1. Driving in excess of speed limits calls a fine of 65 US$ as per (Section 2. C) Traffic Act, Keeping the 60 km/hr. on the highway and 40km/hr. in towns.
  2. Single vehicle accidents or rollovers will call in a fine of $ 1000 USD plus the Excess in section 7 of the Agreement.
  3. Damage to the vehicle caused by careless, reckless driving, Engine Knocking (passing through deep water, calls Fine of US$ 1100 for Toyota Corolla, Rav4 and Toyota Land cruiser US$ 1800.
  4. Damage to the vehicle is caused by lack of proper care as clause 4
  5. Driving on restricted roads/areas like off-tracking in the National Park
  6. During weather conditions like the rainy season, the client has to take care when driving in muddy areas and avoid passing in deep water.
  7. Underbody coverage and damage to the underbody of the vehicle are considered a result of careless driving.
  8. Cross Border Insurance: Our vehicles are insured for use in Rwanda only, Hirer shall not attempt to take the vehicle Cross border without prior consent from the operator and the hirer must buy COMESA insurance which is processed by the operator at USD 40 for 20 Days or fewer days.
  9. Clients going across borders must provide proof of an exit confirmation from the foreign country visited and failure to do so will be subject to a surcharge of USD 200 to drive the car back to that country to exit.

 

  1. DRIVING TIME & ADVICE.

 

  1. The vehicle has to stop operation at 9:00 pm and should start at 5:00 am, anything that happens beyond the mentioned time the hirer will pay for all the damages to the car on top of a 1200$ fine unless consented by the operator.
  2. The Driver Guide will stop driving at 6:00 pm and night game drives are subject to an extra payment of 20 USD with extra payment to park management.
  3. The speed limit in National Park is 40KM/h and don’t go off track, any client who does it is responsible to Pay the 150 USD to Wildlife Authority
  4. Animals in the National Park have 100 % the Right of way and clients are to be 100 Meters away from the Fierce Animals like Elephants and the operator will not be liable for damages to the car.

 

  1. Fuel & Gasoline

Vehicles are generally supplied on a “¼ to ¼ “basis. No credit will be given for unused fuel at the end of the rental.

  1. RETURN VEHICLES

At the start of the rental, the Hirer shall mention the last destination where the car shall be picked from by the operator, deliver the vehicle to the place of business of the Operator or obtain the Operator’s consent to the continuation of the hire (in which case the Hirer must pay additional hire charges for the extended term of hire).

 

  1. Breach of the Contract
  2. Any addition and alterations to these terms and conditions shall be Null and void unless agreed upon in writing by both parties and signed by the operator.
  3. In case of an accident, the client will be subject to a driver for the entire remaining trip period at an extra fee of USD 35 in Rwanda and USD 50 in a foreign country per day.

Any dispute, discrepancy or conflict arising in the interpretation or execution of this agreement shall be settled amicably. Failure to this, the matter shall be referred to competent courts of the Republic of Rwanda situated in Kigali city

Note: If you return the car before the end of your rental period no money is refunded, so if you are not sure of your days to use the car pay at your estimation and when you want to use the extra day communicate to our reservation team and you can make payment at the end but at the same rate.

The operator requires you to notify your final destinations on arrival.
